General Terms of Use of the Simbav Platform and User Information
The Galician Business-University Foundation – hereinafter referred to as FEUGA, with Tax Identification Number G15051667, registered address at Rúa Lope Gómez de Marzoa s/n, 15705 Santiago de Compostela, email address feuga@feuga.es, and registered in the Register of Foundations of the Xunta de Galicia under number 155, makes available to Internet users the PLATFORM www.simbav.es (hereinafter referred to as the PLATFORM) free of charge.
Access to and/or use of the PLATFORM is entirely voluntary and automatically confers upon the person doing so the status of USER. Every USER accepts, from the very moment of accessing the PLATFORM, without any reservation, the content of these “General Terms of Use”, as well as any applicable “Specific Terms” that may supplement, replace, or modify them in any way with regard to the services and content of the PLATFORM.
Consequently, the USER must read both the General and Specific Terms carefully before accessing and using any of the services on the PLATFORM, doing so under their sole responsibility.
In any case, FEUGA reserves the right, at any time and without prior notice, to deny access to this site to any users who fail to comply with these general terms or any applicable specific terms. We also inform you that we comply with the obligation to have at least one of the domains we own registered in the corresponding official registry.
Purpose and Modification of Terms
FEUGA makes available to USERS the possibility of browsing and accessing the contents and services of the PLATFORM, provided that such use is carried out in accordance with the provisions of these GENERAL TERMS OF USE.
In any case, FEUGA reserves the right, at any time and without prior notice, to modify or remove the content, structure, design, services, and conditions of access to and/or use of this site whenever it deems appropriate.
User Responsibility
The USER undertakes to use the services and content provided by the PLATFORM in accordance with applicable legislation, the principles of good faith, and generally accepted practices, and to refrain from acting through the Website in any way that contravenes public order. Therefore, any use for unlawful purposes or that may harm, hinder, damage and/or overload, in any way, the use and normal functioning of the PLATFORM, or that directly or indirectly attacks the PLATFORM or any third party, is strictly prohibited.
The USER shall not transmit through the PLATFORM any content that violates human dignity or fundamental values, in accordance with national and international standards on the protection of human rights.
The USER agrees to provide true and accurate information about themselves when completing the registration form.
Likewise, the reproduction, distribution, transmission, adaptation, or modification of the contents of the PLATFORM website (texts, designs, graphics, information, databases, sound and/or image files, logos…) and other elements of this site, by any means and in any form, is prohibited unless prior authorization has been granted by the legitimate owners or when permitted by law.
Any commercial or advertising use of the aforementioned contents, other than that strictly permitted, if any, is also prohibited, as is any infringement of the rights arising from them.
The USER shall be solely responsible for their use of this site and for full compliance with these GENERAL TERMS. Consequently, the USER undertakes to keep their access credentials, passwords, or similar data assigned to access the PLATFORM or any of its services strictly confidential, treating them as confidential and reserved information. The USER shall be liable for any damage or loss of any nature resulting from misuse, whether by themselves or by third parties—whether such misuse harms the USER directly, due to their own negligence, or affects FEUGA as a result of breaching these GENERAL TERMS.
Any violation of these GENERAL TERMS may result in the initiation of corresponding extrajudicial, civil, or criminal legal proceedings against the USER.
User Registration
FEUGA reserves certain Services offered through the PLATFORM for USERS who have registered by completing the forms available on the Website. Nevertheless, FEUGA also offers certain Services that require USERS to complete additional registration forms in order to access them.
FEUGA will process Personal Data by automated means for the purposes and under the conditions defined in its Privacy Policy, which is included in this Legal Notice.
Disclaimer of Warranties and Liability
FEUGA does not guarantee and shall not be held liable, under any circumstances, for the following situations or contents, nor for any damages or losses that may result from them:
Lack of availability, continuity, access, maintenance, and effective operation of the website and/or its services, as well as the updating, accuracy, completeness, relevance, timeliness, and reliability of its contents, regardless of the cause, including any technical or other difficulties or problems that may result in such circumstances.
The transmission or existence of viruses, harmful elements, or programs that may affect users’ equipment as a result of accessing, using, or browsing the site, or that may cause alterations to their electronic documents or files.
Any unlawful, negligent, fraudulent use, identity impersonation, or use contrary to these General Terms, good faith, generally accepted practices, or public order by USERS when using the website, its services, or contents.
Flaws or defects in the content and/or services accessed through the PLATFORM.
The reception, storage, acquisition, dissemination, or transmission of the PLATFORM’s content by USERS.
Unauthorized third parties becoming aware of or using information regarding the characteristics and circumstances of USERS’ use of the PLATFORM’s contents and services.
Breach by third parties of their obligations related to or derived from the services provided to USERS through the PLATFORM, as well as the lack of quality, reliability, compliance with offers, legality, usefulness, and availability of services provided by third parties and made available to USERS on this site.
The above list is provided by way of example and is not, in any case, exhaustive or exclusive. In all instances, FEUGA EXPRESSLY DISCLAIMS ANY LIABILITY FOR DAMAGES OR LOSSES OF ANY KIND THAT MAY ARISE DIRECTLY OR INDIRECTLY FROM THE ABOVE-MENTIONED ISSUES OR FROM ANY OTHER SIMILAR SITUATIONS NOT SPECIFICALLY ENUMERATED HEREIN.
Intellectual and Industrial Property Rights
The texts, designs, images, databases, logos, structure, trademarks, and other elements of this site are protected by intellectual and industrial property laws and international treaties. Any reproduction, transmission, adaptation, translation, modification, public communication, or any other use or exploitation, in whole or in part, of the content of this site, by any means or in any form—electronic, mechanical, or otherwise—is strictly prohibited without prior written authorization from FEUGA. Any infringement of these rights may give rise to appropriate civil, criminal, or extrajudicial legal proceedings.
FEUGA does not grant any license or authorization for the use of its intellectual or industrial property rights, or of any other property or right related to the PLATFORM, its services, or its contents.
In order to protect potential intellectual property rights, if any USER or third party believes that a violation of their legitimate rights has occurred due to the inclusion of certain content on the Website, they must notify FEUGA of this situation in writing at the following address:

Applicable Law and Jurisdiction
These general terms shall be governed by Spanish law.
For any disputes or legal actions that may arise from the provision of services through the PLATFORM, including its services and content, as well as any issues related to the interpretation, application, performance, or breach of the terms set forth herein, FEUGA and the USER expressly waive any other jurisdiction to which they may be entitled and submit to the jurisdiction of the Courts and Tribunals of Santiago de Compostela.
